Terms & Conditions
These terms govern every booking made with Lomaneva Hotel and Lomaneva Journeys, whether for a room, a tour, or both. Please read them before you confirm a reservation.
01Who we are
Lomaneva Hotel trades as Lomaneva Hotel and Lomaneva Journeys and is the supplier of the accommodation and touring services described on this website. In these terms “we”, “us” and “Lomaneva” refer to that business, and “you” refers to the person making the booking and every guest travelling under it.

02Acceptance of these terms
By requesting a reservation, paying a deposit, or checking in, you accept these terms on behalf of yourself and every person in your party. If you are booking for other people you warrant that you have their authority to do so and that you have brought these terms to their attention.
These terms must be read together with our Payment Terms, Cancellation Policy, Refund Policy and Privacy Policy, each of which forms part of your agreement with us.
Plain language
Section 22 of the Consumer Protection Act 68 of 2008 entitles you to terms written in plain and understandable language. We have drafted these terms accordingly. If any clause is unclear, contact us before you book and we will explain it in writing.
03Definitions
- Booking
- A reservation for accommodation, a tour, a transfer or any combination of these.
- Confirmation
- Our written confirmation issued after we receive the required deposit or full payment.
- Experience
- Any tour, excursion, activity, transfer or dining event listed on this website or in your itinerary.
- Lead guest
- The person who makes the booking and who is responsible for payment and for the conduct of the party.
- Supplier
- A third party that operates part of your itinerary, such as an air operator, rail operator, reserve or activity provider.
- Peak season
- 15 December to 10 January, the Easter weekend, and South African school holiday periods as published by the Department of Basic Education.
04Bookings and confirmation
- A booking request, whether made through this website, by email, by telephone or by WhatsApp, is an offer by you. No contract exists until we issue a written Confirmation.
- We may hold a provisional reservation for 72 hours while you decide. After that period the space is released automatically without notice.
- A Confirmation is issued once the deposit or full payment reflects in our account, and it sets out the rooms, dates, experiences and total amount payable.
- You must check the Confirmation immediately and tell us within 24 hours of any error in names, dates or itinerary. Corrections requested later may attract supplier charges.
- Rates are per the Confirmation and are not adjusted for services you choose not to use.
Obvious errors
Very occasionally a rate is published or quoted in error. Where an error is obvious and you could reasonably have recognised it as a mistake, we may correct it and offer you the corrected rate or a full refund of anything you have paid. We will not enforce a booking against you at a price you did not accept.
05Quotations and pricing
- Tour pricing is not published on this website. Every journey is quoted individually against your dates, group size, season and the suppliers involved.
- Quotations are valid for 7 days from the date of issue unless the quotation says otherwise, and remain subject to availability at the time of confirmation.
- All amounts are quoted and payable in South African Rand (ZAR). Any conversion into another currency is a matter between you and your bank or card issuer.
- Where value-added tax applies, it is charged at the rate prescribed by the Value-Added Tax Act 89 of 1991 and shown separately on your invoice.
- A tourism levy, conservation fee, park entry fee or similar statutory charge may be levied by an authority and, where it is not included in your quotation, this will be stated.
- We may adjust a quoted price before Confirmation where a supplier increases its rates, a statutory levy changes, or the fuel price moves materially. You may withdraw without penalty if you do not accept the adjustment.
06Payment
Deposits, balance dates, accepted methods and our fraud warning are set out in full in the Payment Terms. In summary: a deposit confirms the booking, the balance falls due before arrival, and access to your room or experience is subject to payment having been received.
07Changes and cancellation
Our Cancellation Policy governs amendments, cancellations by you, cancellations by us, and weather-affected experiences. Refunds are dealt with in the Refund Policy.
Your statutory right to cancel
Section 17 of the Consumer Protection Act gives you the right to cancel an advance reservation. We may charge a reasonable cancellation fee, calculated on the sliding scale in our Cancellation Policy. No cancellation fee at all may be charged where the cancellation results from the death or hospitalisation of the person for whom the booking was made.
The 7-day cooling-off right does not apply to dated travel
Section 44 of the Electronic Communications and Transactions Act gives consumers seven days to cancel most electronic transactions. Section 42(2) expressly excludes accommodation, transport, catering and leisure services that a supplier undertakes to provide on a specific date or within a specific period. Because every Lomaneva booking is for specific dates, that cooling-off right does not apply. Your right to cancel under section 17 of the Consumer Protection Act, described above, is unaffected.
08Your obligations
- Check-in is from 14:00 and check-out is by 11:00. Earlier arrival and later departure are subject to availability and may be charged.
- Every guest must present a valid passport or identity document on arrival. We are obliged to keep a guest register and to record these particulars.
- You are responsible for the conduct of your party and for any loss or damage caused to our property, to a supplier's property, or to another guest.
- Smoking is not permitted in rooms or indoor areas. Where a room requires specialist cleaning as a result of smoking, the cost is charged to the lead guest.
- Children remain the responsibility of a parent or guardian at all times, including at the swimming pools, which are not lifeguarded.
- We may refuse service, or require a guest to leave without refund, where conduct is unlawful, endangers others, or materially disturbs other guests.
- You must tell us at booking about any medical condition, allergy, dietary requirement, mobility limitation or pregnancy that could affect your participation in an experience.
09Third-party suppliers
Certain experiences are operated by independent suppliers: air charter and helicopter operators, hot-air balloon operators, the rail operator of the Blue Train, the Robben Island Museum ferry, national and provincial park authorities, skydiving and quad-biking operators, wine estates and restaurants.
- Where we book such a service for you, we do so as your agent, and the contract for that service is between you and that supplier.
- Those suppliers apply their own terms, safety rules, weight and age limits, indemnities and cancellation charges, which we will make available to you on request before you book.
- We select suppliers with care and satisfy ourselves that they hold the licences and insurance their activity requires. We are not, however, liable for the independent acts or omissions of a supplier, save to the extent that the Consumer Protection Act imposes liability on us.
- Where a supplier fails to perform, we will assist you in pursuing that supplier and will refund any amount we are able to recover from it.
10Adventure activities and assumption of risk
Some experiences carry inherent risk that cannot be engineered away: tandem skydiving, hot-air ballooning, helicopter flight, quad biking, hiking on uneven terrain, open-vehicle game drives in a Big Five reserve, and water activities. You choose to take part in these voluntarily.
- You must follow every instruction given by a guide, pilot, instructor or ranger. Most incidents on safari and on adventure activities follow a failure to do so.
- Operators may refuse participation on grounds of weight, age, health, pregnancy, intoxication or weather, and their decision is final. Where an operator refuses participation on safety grounds, the operator's own refund terms apply.
- You will be asked to sign the operator's indemnity before an adventure activity. We cannot waive or vary that document on your behalf.
- Nothing in this clause, and nothing in any indemnity you sign, excludes liability for death or personal injury caused by gross negligence, which section 51 of the Consumer Protection Act does not permit any supplier to exclude.
11Wildlife, weather and operational changes
- Wildlife is wild. We cannot and do not guarantee that you will see any particular animal, including any member of the Big Five, on a game drive.
- Ballooning, skydiving, helicopter flights and the Table Mountain cableway are weather-dependent and are cancelled by their operators on safety grounds. Where an operator cancels, we will reschedule at no charge or refund the amount paid for that activity.
- Roads, viewpoints, reserve gates and heritage sites may close at short notice for weather, maintenance, fire, flooding or safety reasons. Where this happens we will substitute an equivalent alternative or refund the affected portion.
- We may change a guide, vehicle, route or running order where operational circumstances require, provided the standard and character of the experience are maintained.
12Travel documents, visas, health and minors
- You are responsible for holding a valid passport, any visa required for South Africa, and any health documentation required for entry. We are not liable for a refused boarding or a refused entry.
- South African immigration law imposes additional documentary requirements on children under 18 travelling to and from South Africa, which may include an unabridged birth certificate and, in some circumstances, parental consent affidavits. Confirm the current requirements with the Department of Home Affairs well before you travel.
- Where an experience has a minimum age, that limit is set by the operator and is enforced strictly.
- Any medical or dietary information you give us is processed as special personal information under POPIA and is handled as described in our Privacy Policy.
13Travel insurance
Insurance is your responsibility
Comprehensive travel insurance is strongly recommended for every guest and is effectively essential if your itinerary includes adventure activities. Your policy should cover cancellation and curtailment, medical expenses and emergency evacuation, personal accident, and baggage. Check specifically that it extends to skydiving, ballooning, helicopter flight and quad biking, which many standard policies exclude.
We do not sell insurance and we are not authorised financial services providers. We cannot advise you on the suitability of any policy.
14Liability
- We accept liability for loss or damage caused by our own negligence, and for the supply of services that fail to meet the standard required by section 54 of the Consumer Protection Act.
- We are not liable for indirect or consequential loss, including loss of profit, loss of enjoyment beyond the value of the affected service, or missed connections, except where the law does not permit that exclusion.
- Our total liability arising from a booking is limited to the total amount you have paid us for that booking, save in respect of death or personal injury, or where liability may not lawfully be limited.
- Valuables should be placed in the in-room safe. We are not liable for cash, jewellery, electronics or documents left unsecured in a room or a public area.
- Vehicles are parked at the owner's risk within our secured parking area.
What we cannot exclude
Nothing in these terms limits your rights under the Consumer Protection Act. In particular we do not exclude liability for death or personal injury caused by gross negligence, for any misrepresentation, or for harm caused by unsafe goods or services in terms of section 61 of that Act.
15Indemnity
You indemnify us against any claim, loss or cost we suffer as a result of your own unlawful act, your breach of these terms, your failure to follow a safety instruction, or damage caused by a member of your party. This indemnity does not extend to anything caused by our own negligence.
16Force majeure
Neither party is in breach of these terms where performance is prevented by an event beyond its reasonable control, including natural disaster, extreme weather, fire, flood, drought, epidemic or pandemic, an act of government, civil unrest, war, terrorism, industrial action, or the failure of national electricity, water or telecommunications infrastructure.
Where a force majeure event prevents an experience or a stay from going ahead, we will offer you a reschedule, a credit valid for 12 months, or a refund of the amounts we are able to recover from our suppliers, at your election. We will always act in good faith and will not retain more than our unavoidable committed costs.
17Privacy
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013. Our Privacy Policy explains what we collect, why, who we share it with, how long we keep it and how you exercise your rights.
18Intellectual property
- The Lomaneva name, logo, photography, written content, page design and three-dimensional models on this website are our property or are used under licence, and are protected by the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993.
- You may view, download and print pages of this website for your own personal, non-commercial use in planning a stay.
- You may not reproduce, republish, sell or use our photography or content commercially without our written permission.
- Where you post photographs of your stay to social media and tag us, you grant us a non-exclusive, royalty-free licence to repost that image with credit. You may withdraw this at any time by writing to us.
19Complaints and dispute resolution
Tell us at once if something is wrong. A problem raised while you are still with us can usually be fixed on the spot; the same problem raised weeks later often cannot. Speak to the duty manager, and if that does not resolve it, write to info@lomaneva.com.
- We acknowledge every written complaint within 2 business days and give a substantive response within 15 business days.
- If we cannot resolve the matter, you may refer it to the Consumer Goods and Services Ombud, or to the National Consumer Commission established under the Consumer Protection Act.
- Complaints relating to a registered tourist guide may be referred to the Registrar of Tourist Guides in the relevant province under the Tourism Act 3 of 2014.
- Complaints about the handling of personal information may be referred to the Information Regulator, whose details appear in our Privacy Policy.
- Nothing in this clause prevents you from approaching a court of competent jurisdiction.
20Governing law and jurisdiction
These terms, and every booking made under them, are governed by and interpreted according to the laws of the Republic of South Africa, without regard to conflict-of-law rules.
You consent to the jurisdiction of the Magistrate’s Court having jurisdiction over you in terms of section 45 of the Magistrates’ Courts Act 32 of 1944, even where the amount in dispute exceeds that court’s ordinary monetary limit. This does not prevent either party from approaching the High Court where the matter warrants it, and does not limit any statutory forum available to you as a consumer.
21General
- These terms, together with your Confirmation and the policies referred to in them, are the whole agreement between us.
- If any provision is found to be unenforceable, it is severed and the remaining provisions continue in force.
- Our failure to enforce a provision on one occasion is not a waiver of our right to enforce it later.
- You may not cede or transfer your booking to another person without our written consent, which we will not withhold unreasonably where suppliers permit the change.
- We may amend these terms from time to time. The version in force on the date of your Confirmation governs your booking, and the current version is always published on this page.
- Notices to us must be sent to the email or physical address in clause 1. Notices to you are sent to the contact details in your booking.
